Adoption of Rules for Alternative Graduation Requirements for Students Who Entered Grade Nine Prior to 2011-2012

In accordance with Senate Bill (SB) 463, 85th Texas Legislature, Regular Session, 2017, the following commissioner’s rules have been filed as adopted with the Texas Register:

Adopted New 19 TAC Chapter 74, Curriculum Requirements, Subchapter BB, Commissioner's Rules Concerning High School Graduation, §74.1027, Diplomas for Certain Students Who Entered Grade 9 Before 2011-2012 School Year

SB 463 required the commissioner of education to establish criteria to allow individuals who entered high school prior to the 2011-2012 school year and who successfully completed all the curriculum requirements for graduation, but who did not perform successfully on the required state assessment after at least three attempts to qualify for graduation (TEC §74.1027). The new rules establish which individuals may be eligible to graduate and receive a high school diploma by meeting certain alternative requirements in accordance with TEC, §28.02541.

Adopted new 19 Texas Administrative Code (TAC), §74.1027, Diplomas for Certain Individuals Who Entered Grade 9 Before 2011-2012 School Year, will be effective May 3, 2018. Once effective, districts may begin applying the new rules, which will be available in 19 TAC, Chapter 74, Curriculum Requirements, Subchapter BB. Commissioner's Rules Concerning High School Graduation at http://ritter.tea.state.tx.us/rules/tac/chapter074/ch074bb.html.
